Havsbadenuite - Sweden : following multiple complaints from the neighborhood for noise pollution, the court ruled.
The 3 courts are once again free to welcome padel players, but under certain specific conditions set by the judge.
Grouped complaints from the neighborhood
Neighbors' complaints lodged in court were able to end up with the Swedish clubAngelholms Tennisklubb, which has seen its padel activities restricted. This after some neighbors were heard by the Environment Committee and authorizations were issued by the municipality.
The loud noises and clicking noises from the padel game have reportedly had a negative impact on the health and peace of some neighbours for several years, with the nearest neighbour's garden located around twenty metres from one of the courts.
Since last summer, only one of the three courts has been open for padel games between 9 a.m. and 21 p.m. – the other two having been limited to Monday to Friday from 9 a.m. to 18 p.m.
Modification of the decision in court
But since then, the neighbors and the club have appealed the decision and have gone back to court.
On two of the courts, games are now permitted between 9 a.m. and 21 p.m. on weekdays and between 9 a.m. and 18 p.m. on weekends. The third court is open every day from 9 a.m. to 21 p.m.
In its judgment, the court does not in any way question the fact that some neighbors may have been disturbed, but also counterbalances its decisions by explaining that it is essential that a sporting activity be practiced by the general public, in particular for health reasons.
The court asks the municipality of Ängelholm that the club find solutions (without specifying which ones) so that things improve concerning noise pollution.
